1. Acceptance of Terms

By using LullaPage ("the Service"), you agree to these Terms of Service. If you do not agree to these terms, please do not use our service.

LullaPage is operated by Kadima Applications LLC. These Terms of Service constitute a legal agreement between you and Kadima Applications LLC.

2. Service Description

LullaPage creates personalized digital storybooks using AI-generated illustrations based on photos you provide. Our service transforms your photos into 3D animated-style character illustrations that appear in custom bedtime stories.

3. Eligibility & Parental Consent

To use LullaPage, you must:

• Be at least 18 years old
• Have the legal capacity to enter into these terms
• Be a parent/legal guardian of any child whose photo you upload, OR have explicit written consent from the parent/legal guardian

4. Photo Upload Terms & Consent

This is the most important section. By uploading photos, you confirm and agree that:

• You own the photos or have explicit permission to use them
• For photos of minors: You are the parent/legal guardian OR have obtained explicit written consent from the parent/legal guardian
• You grant LullaPage permission to:
  • Process photos using AI to generate stylized illustrations
  • Store photos securely for book access
  • Display generated illustrations within your purchased book
• You understand photos will be processed by AI systems to create stylized 3D animated-style character illustrations

• You do not have rights to use
• Contain inappropriate, explicit, or harmful content
• Depict children in unsafe or inappropriate situations
• Violate any person's privacy rights
• Include anyone who has not consented (or whose guardian has not consented)

Voice Recordings: By recording a voice sample, you confirm you have consent from the person being recorded. Voice samples are processed by ElevenLabs to generate narration and are not used for any other purpose.

5. Acceptable Use

You agree NOT to:

• Upload photos without proper consent or authorization
• Use the service for any illegal, harmful, or fraudulent purpose
• Attempt to reverse-engineer, copy, or exploit our AI systems
• Share books containing other people's children without their parents' consent
• Use our service to create harmful, offensive, or inappropriate content
• Impersonate others or provide false information
• Interfere with or disrupt our service

6. Intellectual Property

• Your Photos: You retain ownership of photos you upload
• Our Technology: LullaPage owns the AI systems, website, story generation technology, and service infrastructure
• Generated Content: Stories and illustrations created for you are licensed to you for personal, non-commercial use
• Sharing: You may share books with family and friends for personal enjoyment
• Restrictions: You may NOT resell, redistribute commercially, or claim ownership of AI-generated content

7. Payment & Refunds

• All prices are in USD
• Payment is processed securely by Stripe
• Full payment is required before book generation begins

If you experience a technical issue preventing book access, contact us and we will resolve it. We reserve the right to refuse service at our discretion.

8. Digital Product Delivery

• Books are delivered instantly via a unique "magic link"
• Links are sent to the email address provided at purchase
• You are responsible for providing a valid, accessible email address
• Books remain accessible as long as LullaPage operates
• We recommend bookmarking your book link for easy access

9. Content & AI Limitations

Please understand:

• AI-generated content may occasionally produce unexpected or imperfect results
• Generated illustrations are stylized interpretations, not exact replicas
• We continuously improve our systems but cannot guarantee perfection
• If you're unsatisfied with output quality, contact support
• We reserve the right to refuse generation of content we deem inappropriate

10. Privacy

Your use of LullaPage is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free service
• Accuracy of AI-generated content
• Compatibility with all devices or browsers

12. Limitation of Liability

To the maximum extent permitted by law:

• LullaPage's total liability is limited to the amount you paid for your book
• We are not liable for indirect, incidental, special, or consequential damages
• We are not responsible for how you choose to share your book links

13. Indemnification

You agree to indemnify and hold harmless LullaPage and its team from any claims, damages, or expenses arising from:

• Your violation of these terms
• Your upload of photos without proper consent
• Your misuse of the service
• Your violation of any third party's rights

14. Termination

We reserve the right to:

• Terminate or suspend access for violation of these terms
• Remove content that violates our policies
• Refuse service to anyone at our discretion

Upon termination, your license to access your books may be revoked.

15. Governing Law

These terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of California.

16. Changes to Terms

We may update these terms occasionally. If we make significant changes:

• We'll update the "Last Updated" date
• We may notify you via email for material changes
• Continued use after changes constitutes acceptance
